TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using TrainTracker ("the Service"), operated by S2 Industries LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

TrainTracker is a community platform for railfans to log, share, and browse train sightings across North America. The Service includes train sighting logging, a community map, photo gallery, locomotive roster, railcam directory, Trackside content feed, creator program, and related features. The Service is available via web browser and mobile applications.

3. User Accounts

You must create an account to submit sightings, post content, or interact with community features. You are responsible for maintaining the security of your account. You must provide accurate information and keep your profile up to date. You may not impersonate another person or use a misleading username. Accounts have a role of either user or admin. Additionally, accounts may be designated as creator (access to publish Trackside content) or moderator (access to content moderation tools), with varying permissions and responsibilities.

4. User Content

You retain ownership of the content you submit, including sightings, photos, gallery uploads, Trackside posts, comments, and profile information. By posting content to TrainTracker, you grant S2 Industries LLC a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the Service and for promotional purposes.

You agree not to submit content that:

• Infringes on intellectual property rights of others
• Contains illegal, harmful, offensive, or inappropriate material
• Reveals private or sensitive railroad security information
• Includes photos taken from trespassing on railroad property
• Is spam, misleading, fraudulent, or intentionally deceptive
• Contains AI-generated images, video game screenshots, or non-original photography in the gallery
• Includes false or misleading alerts, events, or information on Trackside

5. Trackside & Creator Program

Trackside is a content feed where approved creators and administrators can publish alerts, spotlights, and events for the railfan community. Participation in the Creator Program is subject to approval and may be revoked at any time at the sole discretion of S2 Industries LLC.

As a creator, you agree to:

• Post accurate, truthful content relevant to the railfan community
• Only share content you have the right to publish
• Not post misleading alerts or fake events
• Comply with all community guidelines and these Terms of Service

S2 Industries LLC reserves the right to remove any Trackside content, revoke creator status, or restrict access to publishing features at any time without notice. Custom referral links and vanity codes are provided at the discretion of S2 Industries LLC and may be modified or revoked.

6. Community Features

TrainTracker includes community features such as likes, comments, follows, reporting, roster contributions, and corrections. You agree to use these features responsibly and in good faith. Abuse of reporting, voting, or engagement features may result in account restrictions.

7. Railroad Trademarks

Railroad names, logos, and liveries referenced on TrainTracker are trademarks of their respective owners. TrainTracker is an independent railfan platform and is not affiliated with, endorsed by, or sponsored by any railroad company.

8. Safety and Trespassing

TrainTracker promotes safe railfanning practices. Users must observe all trains from public property or designated viewing areas. Content depicting or encouraging trespassing on railroad property will be removed and may result in account suspension.

9. Location Data

Sighting locations you submit are publicly visible on the community map. Do not submit locations that could compromise railroad security or reveal sensitive infrastructure details beyond what is publicly observable.

10. Content Moderation

We reserve the right to review, moderate, remove, or restrict any content at our sole discretion. Content may be automatically screened for inappropriate language or images. Community members may report content they believe violates these terms. Repeated violations will result in account restrictions or permanent suspension.

11. Account Termination & Data Retention

We may suspend or deactivate your account at any time for violations of these terms. You may request account deactivation at any time through the app or by contacting us. Account deactivation will disable your access and hide your profile, but your previously submitted content may be retained in our systems. To request complete deletion of your personal data, contact us at legal@traintrackerapp.com.

12. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. S2 Industries LLC is not liable for any damages arising from your use of the Service, including but not limited to loss of data, unauthorized access, service interruptions, or actions taken by other users.

13. Indemnification

You agree to indemnify and hold harmless S2 Industries LLC, its officers, employees, and agents from any claims, damages, liabilities, or expenses arising from your use of the Service, your content, or your violation of these terms.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. Material changes will be communicated via email or in-app notification.

15. Governing Law

These Terms are governed by the laws of the State of North Carolina. Any disputes shall be resolved in the courts of North Carolina.
